Terms of use

These terms apply when you visit the Money Monty website or ask us to match your business with a finance broker.

1. Acceptance and eligibility

By using Money Monty, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service.

You must be at least 18 years old, be located in or acting for a business in Australia, and have authority to provide information and request a match for that business. The service is for business purposes only and is not intended for personal, household or consumer finance.

2. What Money Monty does

Money Monty is an Australian business finance referral and matching service. We use the information you submit to identify one or more finance brokers who may be suited to your business, funding plans and circumstances. We may then introduce you and share the details needed for the broker to contact you about your request.

A match is an introduction only. You choose whether to speak with a broker, provide further information or proceed with any finance application.

3. No lending, broking or advice

Money Monty is not a lender or finance broker. We do not provide credit, financial, legal, tax or accounting advice, assess applications for a lender, or recommend that a particular finance product is suitable for you.

You should consider your business's circumstances, read relevant documents and seek independent professional advice where needed before making a financial decision.

4. No guarantee from a match

A match does not guarantee that a broker will be suitable for every purpose, that a lender will approve an application, or that finance will be available on any particular terms, rate or timeframe. We do not guarantee a broker's availability, conduct, service quality or performance.

Any application, assessment, offer and agreement is handled by the broker, lender or other third party under their own requirements. You are responsible for deciding whether their services and any proposed finance are appropriate for your business.

5. Your information and authority

You agree to:

  • provide information that is accurate, current and not misleading;
  • update or correct material information if it changes;
  • have authority to act for the business and any person whose details you provide;
  • only submit a genuine business finance enquiry; and
  • review information before relying on it or sending it to a broker or lender.

The quality of a match depends on the information provided. We are not responsible for a mismatch or delay caused by incomplete, inaccurate or unauthorised information.

6. Consent to sharing and contact

When you request a match, you consent to Money Monty sharing your submitted contact, business and funding details with one or more brokers where needed to provide the requested match. You also consent to Money Monty and those brokers contacting you by phone, SMS or email about that request.

You can ask us to stop a match or withdraw consent by contacting us. A broker may already have received your details, so you may also need to contact that broker directly. Withdrawal does not affect handling that has already occurred.

7. Fees and referral arrangements

Money Monty does not charge you for making an introduction. A matched broker may pay Money Monty a referral fee. The existence or amount of a referral fee does not change your responsibility to assess the broker and any finance proposal for yourself.

A broker, lender or other provider may charge its own fees. Ask the relevant provider to explain all fees, commissions and costs before you proceed.

8. Brokers and other third parties

Brokers, lenders and linked websites are independent third parties. They are not our employees, agents or representatives, and we do not control their decisions, content, privacy practices or services. An introduction does not create a partnership, agency, fiduciary relationship or endorsement.

Your dealings with a third party are governed by the terms you agree with that party. Raise concerns about a broker or lender directly with them as well as telling us where relevant.

9. Acceptable use

You must not:

  • use the website unlawfully, fraudulently or to harm another person;
  • submit information you do not have authority to provide;
  • interfere with the website, its security or another user's access;
  • use automated tools to scrape, overload or probe the service without permission;
  • introduce malicious code or attempt unauthorised access; or
  • copy or exploit website content in breach of intellectual property rights.

10. Intellectual property

The website, Money Monty branding, written content, graphics and software are owned by us or used with permission and are protected by intellectual property laws. We give you a limited, revocable and non-transferable permission to use the website for its intended business matching purpose.

You retain rights in information you submit. You give us permission to use, reproduce and disclose that information only as reasonably needed to operate the service, provide your match, comply with law and exercise our rights under these terms.

11. Website availability and information

We aim to keep the website available and useful, but access may be interrupted, delayed or changed. We may correct errors, maintain the service, add or remove features, or suspend the website without notice where reasonably necessary.

General website content is provided for information only. While we take reasonable care, we do not promise that all content is complete, current or free from error.

12. Liability and Australian consumer rights

Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

Subject to those non-excludable rights, Money Monty is not liable for loss arising from a broker's or lender's acts, a finance decision, third-party services, information you supply, or website interruption, except to the extent the loss was directly caused by our failure to use reasonable care or another liability that cannot be excluded.

Where the law permits a remedy to be limited, our liability may be limited to supplying the relevant service again or paying the reasonable cost of having it supplied again.

13. Privacy

Our Privacy Policy explains how we handle personal information. It forms part of these terms and should be read before you request a match.

14. Changes to the service or terms

We may update these terms to reflect changes to the service, our providers or legal requirements. The current version will be posted here with its last updated date. If a change is material, we may give notice in another reasonable way. Your continued use after updated terms take effect means you accept them.

15. Suspension and termination

You may stop using Money Monty at any time. We may refuse, suspend or end access where we reasonably believe these terms have been breached, information is misleading, use creates risk, or suspension is needed for security, maintenance or legal reasons.

Provisions that are intended to continue, including those about intellectual property, third parties, liability and governing law, survive termination.

16. Severability

If any part of these terms is invalid or unenforceable, it will be read down to the minimum extent necessary or removed. The remaining terms continue to apply.

17. Governing law

These terms are governed by the laws of Australia. Courts with jurisdiction in Australia may hear disputes relating to these terms, subject to any rights you have to bring a claim elsewhere under applicable law.
